1. Parties
These Terms & Conditions ("Terms") are an agreement between the host identified below ("Host", "we", "us") and the individual making a booking ("Guest", "you"). By submitting a booking request, you confirm that you have read, understood and accepted these Terms and that you are at least 18 years old and have authority to book on behalf of everyone in your party.
2. The provider and the property
The accommodation is offered by Jernej Osole, a private individual letting on an occasional basis (sobodajalec); full identity, address and registration numbers are stated in the Imprint. The property is Mountain Fairytale · Chalet Rogla, at Rogla 56, 3214 Zreče, Slovenia, on the Zreče–Rogla road at approximately 1,500 m elevation (46.4477307, 15.3349666).
3. Scope of the accommodation service
The Host provides self-catering holiday accommodation only: the whole chalet (2 bedrooms, 3 beds, 2 bathrooms, sleeping up to 5 guests), free Wi-Fi, and the amenities described on this website. No meals, housekeeping during the stay, or other services are included unless expressly agreed in writing before booking. The wood-fired hot tub is operated seasonally, typically April to October, weather and maintenance permitting.
4. Booking and formation of contract
A booking request submitted through this website, by email or by phone is an offer to contract. A binding contract is formed when the Host confirms availability and acceptance of the booking in writing (email or written message). The booking is binding on both parties from that confirmation. If the deposit described in section 6 has not been received within 7 days of the confirmation, the Host may cancel the booking by written notice, at no cost to either party. The Host will provide the pre-contractual information required by law (identity, total price, payment and cancellation terms) before the booking is confirmed, in accordance with Slovenian consumer-protection law (ZVPot‑1) governing distance contracts.
The minimum stay is 4 nights. The maximum occupancy is 5 guests in total, including children; this limit may not be exceeded without the Host's prior written consent.
5. Price and included charges
The total price shown before you confirm a booking includes all mandatory charges you must pay to stay at the property: the accommodation price, any cleaning fee, and the tourist tax (see section 10). Nothing mandatory is added at a later step of the booking process.
- Nightly rate: €135 per night, a flat rate with no seasonal variation.
- Cleaning fee: €40 per stay, charged in addition to the nightly rate.
- Tourist tax: €3.00 per adult per night (see section 10 for the reduced rate for children and the exemption for young children), shown as a separate line and included in the total price.
- Security deposit: not part of the price — see section 7.
All prices are quoted in euro (EUR). The Host is not registered for VAT (mali davčni zavezanec); invoices carry the clause "DDV ni obračunan na podlagi 1. odstavka 94. člena ZDDV‑1 (nismo zavezanci za DDV)."
6. Payment terms
Payment is by bank transfer. The account details (IBAN) are provided in your booking confirmation and are not published on this website. Payment terms:
- Deposit / advance payment: 20% of the total price, due within 7 days of the Host's confirmation. It is refundable in line with section 8.
- Balance: the remaining 80%, due no later than 14 days before arrival. If you book less than 14 days before arrival, the full amount is due within 3 days of the confirmation.
An invoice is issued for every stay.
7. Security deposit (kavcija)
No security deposit is charged. If there is damage beyond normal wear, unusual extra cleaning, or a breach of the house rules, the Host will give you an itemised explanation and may ask you to pay the reasonable cost.
8. Cancellation, modification and right of withdrawal
This property follows a "Flexible"-equivalent cancellation policy:
- Free cancellation: if you cancel at least 24 hours before check-in, you receive a full refund of amounts already paid, other than any non-refundable fees expressly identified as such at the time of booking.
- Cancellation within 24 hours of check-in: a partial refund applies. The price of the first night is not refunded; all remaining nights, the cleaning fee and the tourist tax are refunded.
- No-shows and early departure: a no-show is treated as a cancellation within 24 hours of check-in. If you leave early, nights that start more than 24 hours after you tell the Host are refunded; the cleaning fee is not.
Statutory right of withdrawal — not applicable
Under Slovenian consumer-protection law (ZVPot‑1), implementing the EU Consumer Rights Directive, consumers do not have a statutory 14-day right of withdrawal for accommodation services booked for a specific date or period. This is an explicit legal exception, not a choice made by the Host. Your only cancellation rights are those set out above.
Date or guest-count changes to an existing booking are subject to availability and may be treated as a new booking under these Terms; contact the Host as early as possible using the details in the Imprint.
9. Guest registration (eTurizem) and identification
Slovenian law requires every accommodation provider to record and report certain data for each guest to the national eTurizem system, no later than 12 hours after arrival. Before or at check-in, you must provide: full name, date of birth, gender, nationality, and identity document type and number, for every guest staying at the property, together with arrival and departure dates. This is a legal obligation of the Host, not a marketing request, and is separate from any data Airbnb or another platform may already hold. See the Privacy policy for how this data is used, shared and retained.
10. Tourist tax
The Municipality of Zreče levies a tourist tax (turistična taksa) plus promotional tax (promocijska taksa), together €3.00 per adult per night. Reduced/exempt rates: guests aged 7–18 pay 50% (€1.50 per night); children under 7 are exempt. The tax is collected by the Host on top of the accommodation price and remitted to the municipality; it is not the Host's own income. It is paid together with the balance (see section 6).
11. House rules
The House rules are incorporated into these Terms by reference and form part of the contract. In summary: no smoking indoors, no parties or events, quiet hours apply, pets are welcome at no extra fee subject to reasonable conditions, minimum stay 4 nights, maximum 5 guests. Material breach of the house rules may result in the Host ending the stay without a refund, without prejudice to any other remedy.
12. Guest conduct, occupancy and liability for damage
You agree to: not exceed the maximum occupancy of 5 guests; use the property and its contents with reasonable care; comply with the house rules; and be responsible for the conduct of everyone in your party and any visitors you allow onto the property. You are liable for loss or damage to the property or its contents caused by you, your party or your visitors, beyond normal wear and tear, and the Host may invoice you for the reasonable cost (see section 7).
13. Host liability
The Host will provide the accommodation with reasonable care and skill. To the extent permitted by Slovenian law, the Host's liability is limited to direct damage caused by the Host's own fault, and excludes indirect or consequential loss, loss of enjoyment, or matters outside the Host's reasonable control (see section 14). Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Slovenian consumer-protection law, including liability for death or personal injury caused by negligence.
14. Force majeure
Neither party is liable for failing to perform an obligation under these Terms where that failure is caused by circumstances beyond its reasonable control, including natural disaster, extreme weather, fire, pandemic, war, government action, or failure of essential utilities. Where the Host must cancel a confirmed booking for such a reason, the Guest will receive a full refund of amounts paid for the affected stay.
15. Complaints and dispute resolution
If something is not as expected, please contact the Host directly and promptly, using the details in the Imprint, so the issue can be addressed during your stay wherever possible. If a complaint cannot be resolved directly, consumers habitually resident in the EU may refer the matter to a certified out-of-court dispute-resolution (ADR) body registered with the competent Slovenian authority (the Ministry of Economy, Tourism and Sport); the Host does not recognise any such body as competent and does not take part in such proceedings. Otherwise, the dispute may be brought before the competent court as set out in section 17.
Note: the European Commission's online dispute-resolution (ODR) platform (formerly at ec.europa.eu/consumers/odr) was permanently discontinued in July 2025. It is not available and is deliberately not referenced here.
16. Data protection
Personal data you provide when booking, including the guest-registration data described in section 9, is processed as described in the Privacy policy, which forms part of these Terms.
17. Governing law and language
These Terms are governed by the law of the Republic of Slovenia, without regard to conflict-of-law rules. Nothing in this clause deprives a consumer of protection under mandatory rules of the law of their country of habitual residence, where EU law grants such protection. Any dispute not resolved under section 15 may be brought before the competent court in the Republic of Slovenia.
These Terms are prepared in Slovenian and English, with courtesy translations into further languages. Where any inconsistency exists between language versions, the Slovenian-language version prevails, except where mandatory consumer-protection law of your country of residence provides otherwise.
18. How a booking is concluded (electronic ordering)
Because a booking on this website is concluded by electronic means, Slovenian e-commerce law (Zakon o elektronskem poslovanju na trgu, ZEPT) requires the Host to explain, before you book: the technical steps to conclude the contract; whether the concluded contract is filed and accessible to you; how you can identify and correct input errors before submitting your request; and the languages the contract can be concluded in. This section provides that information; it supplements, and does not replace, section 4 (Booking and formation of contract).
Technical steps to conclude a booking
- You choose your dates on this website and submit a request to book, providing the details requested (dates, number of guests, contact details).
- The Host reviews availability and confirms acceptance of the booking in writing by email (or, exceptionally, another written message), together with the applicable price, payment and cancellation terms.
- You pay the deposit described in section 6 by bank transfer, to the account details given in that confirmation.
- Once these steps are complete, the Host sends a final booking confirmation by email and the booking is treated as confirmed; see section 4 for when the contract becomes binding on the Host.
Filing of the concluded contract
The Host keeps a record of the concluded contract, consisting of your booking request, the Host's written confirmation, these Terms as they applied at the time of booking, and the final booking confirmation. A copy of the booking confirmation is sent to the email address you provided and remains accessible to you there; you may also request a further copy at any time using the contact details in the Imprint.
Identifying and correcting input errors
Before submitting a booking request, check the summary of dates, number of guests and contact details shown on screen, and correct any mistake by editing the relevant field before you submit. If you notice an error in your request after submitting it but before the Host has confirmed your booking, contact the Host immediately using the details in the Imprint so that it can be corrected before the contract is concluded.
Languages the contract can be concluded in
A booking can be concluded, and these Terms are available, in the following languages: English, German, Italian, Spanish, Slovenian, Serbian, Croatian and Hungarian. See section 17 for which language version prevails if there is any inconsistency between them.
19. Severability and final provisions
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in force, and the invalid provision is replaced by one that most closely reflects its original intent within the limits of the law. The Host may update these Terms for future bookings; the version in force at the time you booked applies to your stay, unless a change is required by law.
